UI Benefit Payment Control (BPC) Audits, Overpayments, Fraud and Frequently Asked Questions - Unemployment Insurance

The Benefit Payment Control (BPC) unit promotes and maintains the integrity of the Unemployment Insurance program through prevention, detection, investigation, establishment, recovery and prosecution of UI overpayments made to claimants.

Unemployment Insurance Overpayment

A claimant's eligibility for UI benefits can be subject to adjudication by an agency Specialist. Claimants are sent a Notice of Benefit Determination regarding an employment separation or other eligibility issue. Any decision rendered at this level or subsequent appeal levels, may cause an overpayment of UI benefits already awarded. This information - an overpayment - is listed on the Notice of Benefit Determination.

An overpayment occurs when a recipient (claimant) of unemployment insurance benefits receives a benefit payment for which he/she is not entitled. The claimant is notified via the Notice of Benefit Overpayment of all benefits that have been erroneously paid and for which repayment is requested.

The Notice of Benefit Overpayment lists the section of law, weeks overpaid and overpaid amount. It further notifies claimants of their repayment obligation, procedure for repayment and right to request a 'waiver' of the overpaid amount. In addition to this notification, a second page is included which is a 'Repayment Agreement'. The claimant may opt to repay the agency via monthly installments if unable to reimburse the State the entire overpayment amount immediately.

If the claimant is currently eligible for UI, filing for UI benefits, due an unemployment benefit payment and has an existing overpayment balance, their UI benefit monetary entitlement is applied to the overpayment balance instead of being applied to the claimant's debit card. The original overpayment balance is then reduced by this benefit payment amount. UI claim entitlements cannot be used to recoup interest, court costs or fines.

Other methods of payments include:

  • Due to COVID-19, the 1100 N. Eutaw Street, Baltimore, MD 21201 location is closed to the public. Cash payments cannot be accepted until further notice.
  • Check or money order. Please make payable to Maryland Department of Labor. Mail checks to: P.O. Box 1931, Baltimore, MD 21203;
  • Electronic payment option is available via BEACON;
  • Credit/Debit Card- Convenience fee of 2.5% of payment amount or minimum of $1.00. (Available in BEACON)
  • Pay from Bank Account-Electronic Check - no fee (Available in BEACON)

If payments are not voluntarily made, the following processes may be used to recoup money owed:

  • Wage garnishment from civil judgment;
  • Monies recouped via the State Income 'Tax Refund Intercept Program' (TRIP);
  • Monies recouped via the 'Treasury Offset Program' (TOP); and
  • Money collected via the transferral of accounts to the Maryland Central Collections Unit (CCU).
