Disciplinary Actions - July 1, 2007 to June 30, 2008 - Maryland Real Estate Commission

 

REVOCATIONS

2006-RE-280 & 285 Sherita D. Bostic (Salesperson-Platinum Realty Enterprises, LLC t/a Century 21 Platinum Realty). License REVOKED and licensee FINED $15,000 for violation of § 17-322(b)(2), (3), (25), and (33) and COMAR 09.11.02.01C for providing altered Real Estate Commission licensing documents to a lender in connection with her purchase of property, for making misrepresentations to the lender about her experience and employment in the real estate brokerage business, and for failing to surrender the earnest money deposit she held as the buyer's agent when the contract was terminated as a result of her actions.

2007-RE-611 Kevin Gibson (Salesperson-Century 21/Village Realty). License REVOKED for violation of § 17-322(b)(24) based on a conviction for engaging in a theft scheme over $500.

2007-RE-320 Donald L. Hill, Jr. (Salesperson - Re/Max Supreme). License REVOKED for violation of § 17-322(b)(1), (24), and (25) for providing false information on his application for a real estate license regarding a criminal conviction and for the nature of the criminal activities underlying the conviction.

2006-RE-390 Michael D. Jones (Salesperson-Exit Premier Realty). License REVOKED and licensee FINED $3,000 for violation of §17-322(b)(1), (3), (24), and (25) for failing to reveal a felony theft conviction on his application for a real estate license.

2007-RE-308 Kevin Katz (Salesperson-The Bryan Group, LLC). License REVOKED and licensee FINED $10,000 for violation of § 17-322(b)(1), (24), and (25) for fraudulently obtaining a real estate license by providing false information on the examination form and the application for a license; and for failing to disclose a conviction for child abuse and third degree sexual offense.

2004-RE-215 Alex M. Kombe (Salesperson-Re/Max Allegiance). License REVOKED and licensee FINED $3,500 for violation of § 17-322(b)(14) and (25) for submitting an extension agreement to the seller that had not been signed by the buyers and for failing to promptly provide the buyers with copies of the home inspection report, the HOA requirements, and the extension agreements.

2005-RE-074 Jeffrey S. Lowman (Salesperson-Re/Max One). License REVOKED and licensee FINED $5,000 for violation of §17-322(b)(3), (25), (31), (32), and (33), and §17-502, and COMAR 09.11.01.07, 09.11.02.01C and 09.11.02.02A for sending false and misleading notices to buyers alleging missed settlement dates as a basis for terminating their contracts, for making misrepresentations to the sellers regarding missed settlement dates by the buyers, for failing to act in the best interest of his buyer/client whose contract was terminated, for failing to promptly submit deposit checks to his broker, and for failing to maintain records of real estate transactions.

2004-RE-269 Jeffrey S. Lowman ( Salesperson-Re/Max One). License REVOKED and licensee FINED $5,000 for violation of § 17-322(b)(3), (25), (32), and (33) and §17-532(c)(1)(ii),(iii),(iv), and (vii) and COMAR 09.11.01.12., 09.11.02.01C, and 09.11.02.02A and G for advising the buyer and the seller that the transaction would not go forward unless he was paid a bonus of $5,000 for each of four lots in addition to his commission, and for refusing to forward the buyer's revised offer, which omitted the bonuses, to the seller.

2005-RE-176 Patricia A. Walker (Broker-Reliable Property Management Company). License REVOKED and licensee FINED $5,000 for violation of § 17-322(b)(4), (22), and (33) and COMAR 9.11.01.07 and 09.11.02.01C for failing to provide timely and accurate accountings of income and expense under a property management agreement, for failing to pay routine expenses associated with the rental units as required by the management agreement, for failing to remit rent monies owed to the owners of the units, and for failing to notify the owners of the outcome of court proceedings brought to collect rent. A Guaranty Fund Award in the amount of $5,285.36 was made as a result of the conduct of the licensee.

2005-RE-239 Grant Wing (Salesperson-Re/Max Innovations). License REVOKED and licensee FINED $1,000 for violation of § 17-322(b)(4), (14), (25), and (33) and COMAR 09.11.02.02A for failing to promptly provide a copy of the contract of sale to the buyers, for failing to provide the buyers with a copy of the appraisal report and the termite report, and for failing to disclose to the buyers that he was the loan officer on the loan that he arranged for them.

2006-RE-042 Grant Wing (Salesperson-Re/Max Innovations). License REVOKED and licensee FINED $5,000 for violation of § 17-322(b)(3) and (25) and COMAR 09.11.02.01C for creating a false contract of sale by forging signatures of a buyer and seller and using the contract document to obtain a loan based on the future commission.

2005-RE-241 Felicia Wu (Salesperson-United Realty). License REVOKED for violation of § 17-322(b)(1), (3), (24), and (25) for failing to reveal her criminal convictions and license suspensions in Virginia on her renewal application.

SUSPENSIONS AND FINES

2005-RE-233 Ola Balagun (Salesperson-Century 21/Advantage Realty). License SUSPENDED for 90 days for violation of § 17-322(b)(4), (25), and (33) and COMAR 9.11.02.02A for causing her client to accept a contract when she knew that the property was already subject to another contract, for not obtaining a release of the first contract, and for misrepresenting the availability of the property to the buyer and his agent. A Guaranty Fund Award in the amount of $1,513.50 was made as a result of the conduct of the licensee.

2005-RE-030 Katrina J. Copeland (Broker - Advantage Realty and Community Development). License SUSPENDED for 120 days and licensee FINED $5,000 for violation of § 17-322(b)(22), (25), (33) and COMAR 09.11.01.07 for failing to account for and remit promptly to the owner monthly rent receipts, for failing to retain the security deposit in escrow, for failing to collect late fees from the tenants, for failing to keep adequate records, and for commingling client funds with the her own funds. A Guaranty Fund Award in the amount of $6,225 was made as a result of the conduct of the licensee.

2005-RE-144 David C. Forrester (Salesperson - Re/Max Results). License SUSPENDED for 30 days and licensee FINED $5,000 for violation of § 17-301(a), §17-322(b)(3), (4), and (25), and §17-602(a) for acting as a real estate salesperson when he was not licensed by the Commission, for including his name on a brokerage for sale sign when he was not licensed, and for making material misrepresentations regarding the means of access to the property.

2003-RE-292 Keith Randlett (Salesperson - Re/Max Elite Realty). License SUSPENDED for 60 days and licensee FINED for violation of §17-322(b)(4), (25), and (33) and COMAR 09.11.01.01C and 09.11.02.02A for failing to disclose to the buyers the existence of an easement on the property.

REPRIMANDS AND FINES

2005-RE-032 Mary Lou Bass (Salesperson-Grant Realty). Licensee REPRIMANDED and FINED $2,500 for violation of § 17-322(b)(25) and (33), § 17-502(a), and COMAR 09.11.02.01C for failing to place deposit monies in the broker's escrow account, for removing the key to the property from the lockbox so that it could not be shown, and for arranging telephone service at the property prior to settlement without the knowledge and consent of the seller.

2004-RE-333 Sharon Bernice Taylor (Broker-S. Taylor & Associates). Licensee REPRIMANDED and FINED $2,000 for violation of § 17-322(b)(31) and (33), §17-502(b)(1), and COMAR 09.11.02.02A for failing to deposit trust money in her escrow account and for returning the deposit check to the buyers without the written consent of all parties to the contract.

2005-RE-152 Eric Womack (Salesperson-Re/Max One). Licensee REPRIMANDED and FINED $1,250 for violation of § 17-322(b)(14) and (33) and COMAR 09.11.01.02A for failing to provide a copy of the contract of sale to the seller, and for failing to protect the seller's interests by telling her that the buyers were unable to continue the transaction when that information was not true, in an apparent attempt to avoid the obligation he had undertaken to make certain repairs to the property.

REPRIMANDS

2005-RE-144 Pallie A. Forrester (Salesperson - Re/Max Results). Licensee REPRIMANDED for violation of §17-322(b)(3) and (19), and § 17-527.2(b)(1) for allowing an unlicensed individual to provide real estate brokerage services and giving the impression that the person was licensed by including his name on the brokerage for sale sign along with her own; and for failing to include her name as it appeared on her license on the sign.

2005-RE-416 Thorbjorn R. Larsen, II (Broker -Realty USA). Licensee REPRIMANDED for violation of § 17-322(b)(22) and (31), and § 17-505(a) for failing to account for trust money.

APPLICATIONS DENIED

2007-RE-695 Application for salesperson's license DENIED based on a felony conviction for trafficking in contraband cigarettes and avoiding excise taxes owed to the State of Maryland.

2005-RE-185 Application for associate broker license DENIED based on two convictions involving financial matters related to trust.

GUARANTY FUND AWARDS

2003-RE-243GF Marc Cox (Salesperson-Century 21/Associated Real Estate). A Guaranty Fund award in the amount of $2,204.96 was made as a result of the conduct of the licensee.

2006-RE-373GF Charles Hayes (Broker-Hayes Real Estate). A Guaranty Fund award in the amount of $3,000 was made as a result of the conduct of the licensee.

2007-RE-380GF Shalanda Nix (Salesperson-Re/Max Advantage Realty). A Guaranty Fund award in the amount of $19,000 was made as a result of the conduct of the licensee.

2005-RE-362GF Eric Young (Salesperson-Century 21/Village Realty). A Guaranty Fund award in the amount of $1,713.85 was made as a result of the conduct of the licensee.

CONSENT ORDERS AND AGREEMENTS

2008-RE-654 Margo Adgerson (Salesperson - Urban Realty) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2006-RE-125 Carol Amigo (Associate Broker - Re/Max 100) agreed to complete a three-hour course in basic real estate contract law for violation of § 17-322(b)(33) and COMAR 09.11.02.02A for failing to notify the sellers that the buyers' deposit check had not been received. The course hours are in addition to the continuing education courses required for license renewal.

2005-RE-167 Dale Austin (Salesperson - Mackintosh, Inc.) agreed to a FINE of $750.00 for violating § 17-322(b)(6) for acting as a dual agent representing both parties to a transaction. He also agreed to complete a three-hour course in the law of real estate agency in addition to the continuing education courses required for license renewal.

2008-RE-666 Ernest Banks, Jr. (Broker - Properties International) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2008-RE-726 James G. Bare (Broker - Stan Ridgeway Real Estate, Inc.) agreed to a FINE of $1500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2005-2007 renewal period.

2005-RE-151 Bonnie Bell-Halliburton (Salesperson - RE/MAX Allegiance) agreed to a REPRIMAND and a FINE of $500.00 for violation of § 17-322(b)(6), § 17-530(c) and (d), and COMAR 09.11.02.02A by acting as a dual agent for both parties in the same transaction. She also agreed to complete a three-hour course in agency in addition to the continuing education courses required for license renewal.

2006-RE-046 William J. Blondell, III (Salesperson - Re/Max Signature Realty LLC) agreed to a FINE of $500.00 for violation of COMAR 09.11.01.12 for failing to obtain the sellers' signatures on the listing agreement prior to advertising, showing, or offering the property for sale.

2008-RE-585 Mary Colleen Boswell (Salesperson-Long & Foster Real Estate, Inc.), agreed to a FINE of $1,500 and a $100 administrative fee for violation of Section 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2008-RE-635 Andrew E. Bowen (Salesperson - Coldwell Banker Residential Brokerage) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2008-RE-678 Mark Brown, Jr. (Associate Broker - Real Estate Professionals, Inc.) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

She also agreed to pay the buyers $4,350.00.

2007-RE-072 Haleh Esfahanian (Salesperson - Long & Foster Real Estate, Inc.) agreed to pay a FINE of $250 for violation of §17-322(b)(32) and (33), 17-527.2(b)(1), and 17-527.3(a), and COMAR 09.11.02.02D for failing to disclose her relationship (daughter-in-law) to the seller, and for using a name other than her name as registered with the Commission on the contract of sale and related documents, as well as on the information entered into MRIS. She also agreed to complete a three-hour course in either real estate ethics or general real estate law in addition to the continuing education courses required for license renewal.

2008-RE-599 Carmen Celia Flynn (Salesperson - Coldwell Banker Residential Brokerage) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2008-RE-594 Constance C. Harvey (Broker - Harvey Realty Group, Inc.) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2008-RE-708 Harry Hild, Jr. (Salesperson - All American Residential Realty) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2005-2007 renewal period.

2007-RE-348 Cheryl A. Holley (Salesperson - Fairfax Realty, Inc.) agreed to a REPRIMAND for violation of §§ 17-322(b)(25) and 17-530(b) for failing to disclose to the buyer or to her broker that she was the resident agent for United Home Buyers, Inc., the entity that the buyer contracted with for assistance in locating and purchasing a home, and, when she accepted a referral from that company to assist the buyer, for failing to prepare a written buyer-broker agreement. She also agreed to pay $2,908 to the Claimant.

2008-RE-752 James Brent Hooper (Broker - Hopper & Associates) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2005-2007 renewal period.

2008-RE-670 Robert P. Howard (Broker - Exit Tri-County Realty) agreed to a FINE of $1,500 and a $100 administrative fee for violation of Section 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2006-RE-152 Mary Beth Incorvati (Salesperson - Keller Williams Preferred Properties) agreed to a FINE of $500.00 for violation of § 17-322(b)(19), (25), and (33) and COMAR 09.11.01.12 and 09.11.02.02A for failing to have a signed listing agreement, and for advertising a property with one broker when the property was not listed by that broker. She also agreed to complete a three-hour course in general real estate law in addition to the continuing education courses required for license renewal.

2008-RE-633 Yohn S. Kang (Broker- Sweet Homes Realty) agreed to a FINE of $1,500 and a $100 administrative fee for violation of Section 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006 -2008 renewal period.

2004-RE-368 Tianran Ke (Salesperson - K&Y Realty) agreed to a REPRIMAND for violation of §§ 17-322(b)(19), 17-527.2(b), and 17-527.3(a) for advertising using a name other than his name as registered with the Commission.

2008-RE-751 Robert T. Koger (Broker - Molinaro Koger, Inc.) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2005-2007 renewal period.

2005-RE-159 Christopher Kwegan (Salesperson - Paragon Realtors, LLC) agreed to a three-month SUSPENSION of his license for violation of § 17-322(b)(25) and COMAR 09.11.02.01C for failing to maintain a copy of a contract of sale related to a transaction and failing to notify his broker of the transaction. He also agreed to complete a three-hour course in ethics in addition to the continuing education course requirements for license renewal. He further agreed that he must file an application for reinstatement of his license after the period of suspension, and agreed to pay the Claimant $4,129.90.

2008-RE-736 James S. Long (Broker - Washington Properties) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2005-2007 renewal period.

2008-RE-588 William A. Lusby (Salesperson - O'Brien Realty) agreed to a FINE of $1,500 and a $100 administrative fee for violation of Section 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2006-RE-017 Patrick K. Powers (Broker - TCT Management, Inc.) agreed to a REPRIMAND and a FINE of $500.00 for violation of § 17-322(b)(32) and § 17-602(a) for representing to the public that he held a real estate license when in fact his license had expired.

2006-RE-314 Yigal Rappaport (Broker - Yigal Rappaport) agreed to a FINE of $5,000 for violation of § 17-322(b)(24)(ii),(25) and (32) and § 17-305 (b) based on his conviction in U.S. District Court for the Eastern District of Virginia of the misdemeanor crime of submitting a false statement to the Department of Housing and Urban Development.

2006-RE-407 Samuel C. Reynolds, Sr. (Broker - Reynolds Company, Inc.) agreed to a FINE of $1,000 for violation of § 17-322(b)(25) for failing to correct misrepresentations made by his son that he was a licensed real estate agent when he was not, and for failing to ensure that the contract of sale properly reflected the agreement of the parties regarding financing.

2008-RE-598 Joan Rivera (Broker - J.H. Rivera Enterprises Realty) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2008-RE-595 Barbara Rounds (Broker - Crimmins & Associates Real Estate) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2006-2008 renewal period.

2007-RE-510 Lee Shpritz (Salesperson - Inner Harbor Realty, Inc.) agreed that he would be ineligible for licensure for a three-year period, beginning on January 14, 2008, for violation of § 17-322 (b)(3) and (25) for falsifying applications for FHA-insured mortgages without the buyers' knowledge, for increasing the sales prices of the homes he was selling without the buyers' prior knowledge or consent, for stating that the properties had been inspected when they had not, and for failing to reveal to the buyers his status as a loan originator for the lender as well as being the seller of the property.

2006-RE-286 Eva Jane Simmons and Phyllis James (Salesperson and Broker - ERA Phyllis James & Associates). Eva Jane Simmons agreed to a REPRIMAND for violation of § 17-322(b)(25) for failing to obtain permission in writing for a wife to sign her husband's name to a contract. Phyllis James agrees to pay $5,682.21 to the Claimants.

2005- RE-026 Vito Simone (Broker - Tenant Buyer Homes, LLC) agreed to a FINE of $500.00 for violation of § 17-322(b)(33) and COMAR 09.11.02.01D for listing a property as being fee simple when in fact it was subject to a ground rent. He also agreed to complete a three-hour course in ethics in addition to the continuing education courses required for license renewal.

2006-RE-328 Nancy Simpers (Associate Broker - Prudential Carruthers Realtors) agreed to a FINE of $1,000 for violation of COMAR 09.11.02.01H for failing to ensure that financial obligations and commitments regarding repair of termite damage were in writing and signed by the parties to the transaction.

2008-RE-765 George Soo Hoo (Broker - Kosmo Properties) agreed to a FINE of $1,500 and a $100 administrative fee for violation of § 17-315 by failing to evidence completion of the required number of continuing education hours for the 2005-2007 renewal period.
