#21-199 In the matter of Jockey Joel Rosario;

On December 2, Joel Rosario withdrew his appeal with the Maryland Racing Commission.
Mr. Rosario will serve three (3) Maryland racing days December 9, 10 and 11, 2021.

RULINGS:
#21-200 In the matter of, Ivan Perez-Modesto, subject of Stewards Ruling #20-185, dated December 12, 2020.

On December 17, 2021, Ivan Perez-Modesto appeared before the Stewards upon the request of HCP Coordinator Jessica Hammond, for consideration of reinstatement to good standing. Mr. Perez provided that he is currently in a program “Back on Track”. In their evaluation they indicate that Mr. Perez is presently drug free and not a detriment to the best interests of racing. She recommended that he be reinstated to good standing and permitted to return to work subject to the following stipulation:


That at the Stewards discretion he submits to drug testing by the HCP Coordinator, the Stewards, or their designated representative. [COMAR 09.10.03.05.]

In light of the above, the Stewards hereby order that Ivan Perez-Modesto be reinstated to good standing subject to the above-stated stipulation.

#21-201 In the matter of owner, Voodoomon Racing, subject, of Steward’s Ruling #21-174. Having satisfied their
financial obligation to the Maryland Thoroughbred Purse Account as of December 8, 2021 the afore
mentioned ownership is reinstated to good standing with the Maryland Racing Commission and declared
eligible to participate in racing.

#21-202 In the matter of owner, Lucky Man Racing LLC, subject, of Steward’s Ruling #21-177. Having satisfied their
financial obligation to the Maryland Thoroughbred Purse Account as of December 8, 2021 the afore
mentioned ownership is reinstated to good standing with the Maryland Racing Commission and declared
eligible to participate in racing.

RULINGS:
#21-203 Trainer, James Lawrence is fined Twenty-five dollars ($25.00) for not having the colors for
“Too Much Tip”, entered to run in the eighth race at Laurel Park on December 19, 2021, after receiving a
warning on (09/17/2021) for the same offense.

THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part……

“It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the
jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.

(Note: As per COMAR 09.10.04.05, failure to pay a fine within 48 hours from being notified may result in a suspension of license.)

#21-204 Trainer, Michael Trombetta, fined two hundred and fifty dollars ($250.00) for failure to report the
proper gender of his entry “Whenigettoheaven” that ran on December 18, 2021.

 

(Note: As per COMAR 09.10.04.05, failure to pay a fine within 48 hours from being notified may result in a suspension of license.)

#21-205 Jockey, Xavier Perez is fined Two hundred and fifty dollars ($250.00) for violating the riding crop
rule, in the second race at Laurel Park on December 19, 2021.

RULINGS:
#21-206 Jockey, Jean Alvelo, is fined two hundred and fifty dollars ($250.) for failure to put forth every effort in riding his mount, “Lost My Voucher”, out to the finish, in the fifth race at Laurel Park on December 27, 2021.

[Violation of COMAR 09.10.01.21-1 Q (1 (2)]

#21-207 Trainer Miguel Penaloza is fined Five Hundred ($500.) for failing to have his horse “Sneakiness” in the paddock for the sixth race on December 27, 2021 resulting in an unwarranted late scratch and a refund of all monies wagered on said horse.

#21-208 In the matter of owners, Arthur W. Tsiamis and Mihee Pansiri, subject, of Steward’s Ruling #21-184. Having
satisfied their financial obligation to the Maryland Thoroughbred Purse Account as of December 8, 2021
the afore mentioned ownership is reinstated to good standing with the Maryland Racing Commission and
declared eligible to participate in racing.
