May 2017 Thoroughbred Rulings - Maryland Racing Commission

May 5, 2017 - Laurel Park
#17-074 In the matter of the second race at Laurel Park on February 10, 2017, regarding the Stewards Ruling #17-073, involving the horse "Story Spinner”.

On May 4, 2017 trainer Mary E. Eppler filed an appeal with the Maryland Racing Commission, on behalf of Mary E. Eppler Racing Stable, Inc. and Adam Staple, the owners of “Story Spinner”. The appeal disputes the Stewards' decision to disqualify "Story Spinner”, winner of the second race at Laurel Park on February 10, 2017.

As a result of that appeal, the second race on February 10, 2017, is hereby declared in dispute and the following ordered to remain in effect until the dispute has been settled by the Maryland Racing Commission:

  1. Both “Story Spinner” and “Beltway Bob” shall be subject to all penalties attached to the winner of the race [COMAR 09.10.04.15, A(1)]; and
  2. The purse monies affected by the dispute are to be held by the Horsemen's Bookkeeper.

May 5, 2017 - Laurel Park
#17-075 In the ninth race, at Laurel Park on May 4, 2017, horse #8 “Egber”, ridden by jockey, Katie Davis was disqualified from third position and placed fifth for coming in, at about the 3/8th pole, in front of #4 “Perfect Party Girl” without sufficient clearance, causing the rider to have to sharply check his horse to avoid clipping heels.
[Violation under COMAR 09.10.01.50, A (1)a, b, d & e , which states in pertinent parts: “A horse may not: (a) Carry another horse in or out, (b) Cross in front of another horse without sufficient clearance, (d) Intimidate another horse, or (e) Impede another horse.]

May 6, 2017 - Laurel Park
#17-076 Jockey, Katie Davis, is suspended five (5) Maryland racing days, May 7,11,12,13 & 14, 2017, for riding the horse “Egber” in a careless manner in the ninth race at Laurel Park on May 4, 2017, thereby causing the disqualification of “Egber” from third to fifth position.
[COMAR 09.10.01.50, §A(2)(b) and §C.]

At about the 3/8th pole, Ms Davis moved her horse #8 “Egber” in, in front of #4 “Perfect Party Girl” without sufficient clearance, causing the rider to sharply check his horse to avoid clipping heels.

May 6, 2017 - Laurel Park
#17-077 In the matter of stable employee Nicholas Dilodovico;

COMAR 09.10.03.05 A(1)(a),D

A hearing was held on May 6, 2017. Mr. Dilodovico appeared with Attorney Richard Hackerman. Mr. Dilodovico was requested to deliver a urine sample. Mr. Dilodovico complied and the sample came back positive for marijuana. COMAR 09.10.03.05 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:

  1. That the license issued to Nicholas Dilodovico be suspended until such time as he has been professionally evaluated [COMAR 09.10.03.05, F(1)(2)(a)(b)].
  2. That while he is under suspension, Mr. Dilodovico be denied the privileges of all the grounds under the jurisdiction of the Maryland Racing Commission. [COMAR 09.10.01.45, 'Y (1) (a).].

May 6, 2017 - Laurel Park
#17-078 Trainer, Edward Barker is fined
twenty-five dollars ($25.00) for not having the colors for, “Kissin Cassie”, entered to run in the seventh race at Laurel Park on May 5, 2017, after receiving a warning on (02/19/2017 ) for the same offense.

May 6, 2017 - Laurel Park
#17-079 In the matter of owner, Michelle Winters, subject, of Steward’s Ruling #15- 064 dated February 2, 2015.

Having satisfied her financial obligation to the Maryland Thoroughbred Purse Account as of May 6, 2017, owner Michelle Winters is reinstated to good standing with the Maryland Racing Commission and declared eligible to participate in racing.

May 6, 2017 - Laurel Park
#17-080 In the matter of owner, Odin Londono, Jr., subject, of Steward’s Ruling #17- 070 dated April 28, 2017.

Having satisfied his financial obligation to the Maryland Thoroughbred Purse Account as of May 6, 2017, owner Odin Londono, Jr. is reinstated to good standing with the Maryland Racing Commission and declared eligible to participate in racing.

May 11, 2017 - Pimlico Race Course
#17-081 Trainer, Wayne Potts is fined
two hundred dollars ($200.00) for failure to have the foal certificate on file with the Horse Identifier for his entry “Zipline”, entered to run in the second race at Pimlico Race Course on May 11, 2017.

#17-082 Trainer, Timothy Woolley is fined
two hundred and fifty dollars ($250.00) for failure to report the proper gender of his entry “Fusion Xchange” that ran on May 7, 2017.

#17-087 In the matter of Apprentice-jockey Ashley Castrenze, having provided, all documentation
necessary pertinent to her racing injury of October 16, 2016, apprentice jockey Castrenze is hereby granted (179) days of extension to her apprentice certificate, which would have expired on May 21, 2017. This extension will now continue her apprentice allowances starting May 22, 2017 until November 16, 2017.

Having satisfied their financial obligation to the Maryland Thoroughbred Purse Account as of May 17, 2017, owners Wachtel Stable and Kerr, George J, are reinstated to good standing with the Maryland Racing Commission and declared eligible to participate in racing.

May 18, 2017 - Pimlico Race Course
#17-090 In the matter of owners, Wachtel Stable, Kerr, George J. and Barber, Gary, subject, of Steward’s Ruling #17-016 dated February 11, 2017.

Having satisfied their financial obligation to the Maryland Thoroughbred Purse Account as of May 17, 2017, owners Wachtel Stable, Kerr, George J, and Barber , Gary are reinstated to good standing with the Maryland Racing Commission and declared eligible to participate in racing.

Two Hundred dollars ($200.), for failure to have her entry, “Road Agent”, treated with furosemide (lasix) three hours before post time for the third race at Pimlico Race Course on May 18, 2017.

  2. Mr. Cox will be assigned one half (½) Multiple Medication Violation Point.

#17-093 In the matter of trainer Dale Capuano, subject of Stewards’ Rulings #16-130;

Trainer Capuano having dropped his appeal with the Maryland Racing Commission will accept the following penalty:

  1. Mr. Capuano is fined five hundred dollars ($500.)
  2. Mr. Capuano will be assigned one half (½) Multiple Medication Violation Point.

#17-094 In the eleventh race, at Pimlico Race Course on May 20, 2017, horse #2 “Hedge Fund”, ridden by jockey Javier Castellano was disqualified
from fourth position and placed sixth, behind horse #4 “Society Beau”, ridden by jockey Corey Lanerie. Inside the 3/16 th marker, #2 “Hedge Fund” drifted out into the path of #4 “Society Beau”, forcing the rider to check sharply and alter course.

May 28, 2017 - Pimlico Race Course
#17-097 In the matter of stable employee Nicholas Dilodovico, subject of Stewards Ruling #17-077, dated May 6, 2017.

On May 28, 2017, Nicholas Dilodovico was represented by HCP Coordinator, Jessica Hammond, before the Stewards, for a hearing on his request to be reinstated to good standing. The HCP coordinator provided the results of drug tests and an evaluation from Adult Personal & Career Counseling indicating that Mr. Dilodovico is presently drug free and not a detriment to the best interests of racing. She recommended that he be reinstated to good standing and permitted to return to work subject to the following stipulation:

That at the Stewards discretion he submit to drug testing by the HCP Coordinator, the Stewards, or their designated representative. [COMAR 09.10.03.05.]

In light of the above, the Stewards hereby order that Nicholas Dilodovico be reinstated to good standing subject to the above-stated stipulation.

May 28, 2017 - Pimlico Race Course
#17-098 In the ninth race, at Pimlico Race Course on May 25, 2017, horse #6 “No Love Lost”, ridden by jockey Katie Davis was disqualified from third position and placed fourth
, behind horse #3 “Shackle Me Good”, ridden by jockey Emmanuel Esquivel. Inside the 1/16 th marker, #6 “No Love Lost” drifted out into the path of #3 “Shackle Me Good”, forcing the rider to check sharply to avoid clipping heels.

#17-099 In the ninth race, at Pimlico Race Course on May 27, 2017, horse #2 “The Great Provider”, ridden by apprentice jockey, Carlos Carrasco was disqualified from fifth position and placed sixth.
Out of the gate, #2 “The Great Provider” broke in hard towards the rail and took away the path of #1 “D C Dancer”, ridden by Victor Carrasco, causing that rider to sharply check his horse.
