Notice of Proposed Action

The State Athletic Commission proposes to adopt new Regulation .08 under COMAR 09.14.02 Applications and Licensing. This action was considered at a public meeting of the Commission held on November 28, 2018, notice of which was provided by posting on the Athletic Commission's website pursuant to General Provision Article, §3-302(c)(3)(ii), Annotated Code of Maryland.

Statement of Purpose

The purpose of this action is to establish by regulation an applicant's or licensee's obligation to respond in writing within 30 days to a written communication from the Commission, to inform the applicant or licensee of the ramifications for failure to respond to a written communication from the Commission and to require an applicant or licensee to notify the Commission in writing of a change of address.

The proposed action has no economic impact.

Open Meeting

Final action on the proposal will be considered by the State Athletic Commission during a public meeting to be held on February 20, 2019, at 3 p.m., at the Department of Labor, Licensing, and Regulation, 500 N. Calvert Street, Third Floor, Baltimore, MD 21202.

.08 Failure to Respond.
  A. If an applicant or licensee receives from the Commission a written communication requesting a response, the applicant or licensee shall respond within 30 days of the date of the mailing.
  B. The Commission shall send a written communication by first-class mail to the last address furnished to the Commission by an applicant or licensee.
  C. It is a responsibility of an applicant or licensee to notify the Commission in writing if there has been a change in applicant’s or licensee’s address.
  D. Failure to respond as required by this regulation may be considered by the Commission to be a violation of Business Regulation Article, §4-310(a)(1)(iii) or (iv), Annotated Code of Maryland.
